1. Definitions
For purposes of these Terms & Conditions:
- "Service" refers to the residential care services provided by dovecresa
- "Resident" refers to individuals receiving care services
- "Family" or "Representative" refers to designated family members or legal representatives
- "We," "Us," "Our" refers to dovecresa
- "Agreement" refers to the service contract entered into between dovecresa and the resident or their representative
2. Acceptance of Terms
By using our website, inquiring about services, or entering into a service agreement with dovecresa, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services or website.
Residents or their legal representatives must be 18 years of age or older to enter into agreements with dovecresa. Our services are designed for adults aged 60 and above.
3. Service Description
dovecresa provides non-medical residential care services in Bangkok, Thailand. Our services include:
- Gentle Daily Presence: Respectful personal care assistance and companionship
- Nature Connection Program: Outdoor-focused activity programming
- Urban Garden Residential Living: Comprehensive residential care including accommodation, meals, and support
Services are available subject to capacity and appropriateness of fit. We reserve the right to decline service if we determine that a resident's needs exceed our scope of non-medical care.
4. Service Agreements
All residential care services require a written service agreement outlining:
- Service level selected and specific services included
- Monthly fees and payment terms
- Duration and termination provisions
- Responsibilities of both parties
- Emergency contact procedures
Service agreements are individualized and may be adjusted as needs change, subject to mutual agreement.
5. Fees and Payment
Payment terms:
- Monthly service fees are billed in advance on the first day of each month
- Payment is due within 7 days of invoice date
- Accepted payment methods include bank transfer and cash
- Late payments may result in suspension of optional services
- A security deposit equivalent to one month's fee is required before services begin
Fee increases will be communicated at least 60 days in advance. Current residents may terminate services within 30 days of notification if they do not accept the increased fees.
6. Service Modifications
Service levels may be adjusted through mutual agreement when:
- Resident's needs change and require different support levels
- Family or resident requests modification
- We determine that current services no longer match needs appropriately
Changes to service levels will be documented in writing and reflected in updated billing. We commit to discussing any recommended changes with residents and families before implementation.
7. Scope of Services
dovecresa provides non-medical residential care. Our services do not include:
- Medical diagnosis, treatment, or nursing care
- Medication administration or management
- Specialized dementia or memory care
- 24-hour one-on-one monitoring or supervision
- Behavioral management for significant cognitive impairment
Residents requiring medical care should arrange appropriate healthcare services independently. We can coordinate with healthcare providers but do not provide medical services ourselves.
8. Resident and Family Responsibilities
Residents and their families agree to:
- Provide accurate information about health status, needs, and preferences
- Update emergency contact information promptly when it changes
- Inform us of significant changes in health or care needs
- Maintain appropriate health insurance and arrange medical care independently
- Treat staff and other residents with respect
- Comply with facility policies regarding safety and community living
- Provide timely payment for services
9. Termination
9.1 Termination by Resident or Family
Services may be terminated with 30 days' written notice. The security deposit will be returned within 14 days after final services are provided, minus any outstanding balances.
9.2 Termination by dovecresa
We reserve the right to terminate services with 30 days' notice if:
- Resident's needs exceed our scope of non-medical care
- Payment obligations are not met after reasonable attempts to resolve
- Resident or family behaviors compromise staff or resident safety
- Service agreement terms are materially breached
In cases requiring immediate termination for safety reasons, we will provide assistance in finding alternative care arrangements.
10. Liability and Disclaimers
While we take reasonable care in providing services, residents acknowledge that:
- We cannot guarantee specific health outcomes or improvements
- Participation in activities carries inherent risks typical of daily living
- We are not liable for losses or damages to personal property except in cases of staff negligence
- Our liability is limited to direct damages and does not exceed total fees paid in the preceding six months
This limitation does not apply to cases of gross negligence or willful misconduct.
11. Privacy and Confidentiality
Personal and health information is handled in accordance with our Privacy Policy and applicable data protection laws. We maintain confidentiality of resident information except as required by law or authorized by residents or their representatives.
12. Governing Law and Disputes
These terms are governed by the laws of Thailand. Any disputes arising from services or these terms will be resolved through:
- Good faith discussion between parties
- Mediation if direct discussion does not resolve the matter
- Arbitration or courts in Bangkok, Thailand, if mediation is unsuccessful
13. Changes to Terms
We may update these Terms & Conditions periodically. Significant changes affecting current service agreements will be communicated in writing with at least 30 days' notice. Continued use of services after notice constitutes acceptance of updated terms.
